This Acceptable Use Policy ("AUP") governs the use of all virtual private servers, network resources, and related services ("Services") provided by FinTechVPS Technologies LLC ("FinTechVPS," "we," "us," or "our"). This AUP is incorporated by reference into the FinTechVPS Terms of Service and applies to all customers, users, and any third parties who access the Services through a FinTechVPS customer's account. The purpose of this AUP is to protect the integrity, performance, and availability of our infrastructure for all customers, and to ensure that FinTechVPS is not used to facilitate illegal, harmful, or abusive activities. By using the Services, you agree to comply with this AUP at all times. We reserve the right to update this AUP at any time; continued use of the Services constitutes acceptance of any revised policy.
FinTechVPS infrastructure is purpose-built for the financial technology and trading community. The following uses are expressly permitted and encouraged:
The following activities are strictly prohibited on FinTechVPS infrastructure. This list is illustrative and not exhaustive. FinTechVPS retains sole discretion to determine what constitutes a violation of this AUP.
Illegal Activity. Using the Services in connection with any activity that violates applicable federal, state, local, or international law or regulation, including without limitation securities fraud, market manipulation, money laundering, wire fraud, unauthorized access to computer systems, and violations of the Computer Fraud and Abuse Act (CFAA) or equivalent laws in other jurisdictions.
Spam & Unsolicited Communications. Sending unsolicited bulk email (spam), operating open mail relays, conducting phishing campaigns, or transmitting any unsolicited commercial communications in violation of the CAN-SPAM Act or similar laws. Hosting or operating infrastructure used by others to send spam.
Network Attacks & Intrusion. Conducting port scans, vulnerability scans, or network reconnaissance against systems you do not own or have explicit written permission to test. Launching or facilitating denial-of-service (DoS) or distributed denial-of-service (DDoS) attacks against any target. Attempting to gain unauthorized access to systems, networks, or data. Operating booter or stresser services of any kind.
Malware & Harmful Code. Uploading, distributing, or hosting viruses, trojans, ransomware, spyware, rootkits, or any other malicious software. Operating command-and-control (C2) infrastructure for botnets or malware campaigns.
Cryptocurrency Mining. Running cryptocurrency mining, proof-of-work computation, or similar resource-intensive workloads on any FinTechVPS server without prior written authorization from FinTechVPS. Due to the impact on shared infrastructure health and the specialized nature of our platform, mining workloads are not an approved use case and will result in immediate account termination.
Intellectual Property Violations.Storing, distributing, or transmitting material that infringes any third party's copyright, trademark, patent, trade secret, or other intellectual property rights. Hosting pirated software, cracked applications, or unauthorized copies of trading platforms or financial software.
Fraudulent Financial Activity. Using the Services to operate unauthorized exchanges, Ponzi schemes, fraudulent investment platforms, pump-and-dump schemes, or any activity designed to deceive investors or regulators.
Resource Abuse. Consuming excessive network bandwidth, CPU, or storage in a manner that materially degrades performance for other customers. Using the Services as a general-purpose hosting platform for large-scale content delivery, file sharing, or streaming unrelated to financial trading operations.
Proxy & Anonymization Services. Operating open proxies, Tor exit nodes, or anonymization services that facilitate prohibited activity or make it difficult to trace malicious traffic to its origin.
Each VPS plan includes defined allocations of CPU cores, RAM, SSD storage, and monthly bandwidth as specified on your order. You may use these resources for any permitted purpose up to their stated limits. Sustained use that consistently saturates CPU at 100% for extended periods, or generates network traffic substantially in excess of your plan's bandwidth allocation, may result in resource throttling, an upgrade requirement, or account suspension at FinTechVPS's discretion. FinTechVPS does not currently impose burst throttling for short-duration spikes and understands that trading workloads may be bursty in nature; however, sustained resource abuse that affects other customers will not be tolerated.
Bandwidth overages beyond plan limits are billed at the overage rate shown in your plan details at the time of purchase. We will make reasonable efforts to notify you before overage charges accrue.
FinTechVPS reserves the right, but does not assume the obligation, to monitor the Services for compliance with this AUP. Upon becoming aware of a potential violation, we may take any of the following actions at our sole discretion and without prior notice, depending on the severity and nature of the violation:
Where circumstances permit, FinTechVPS will attempt to notify the account holder and provide an opportunity to cure a violation before taking action. However, in cases involving active attacks, illegal activity, or imminent harm to infrastructure or third parties, immediate action without notice may be necessary. FinTechVPS shall not be liable for any damages or losses resulting from enforcement actions taken in good faith pursuant to this AUP.
Customers are responsible for ensuring that any third parties who access the Services through their accounts β including employees, contractors, and end users β comply with this AUP. A violation by any such party is deemed a violation by the account holder.
If you become aware of any activity that violates this AUP β whether by a FinTechVPS customer or involving FinTechVPS infrastructure β we encourage you to report it promptly. Abuse reports help us maintain a safe and reliable environment for all customers in the trading community. Please submit abuse reports to support@fintechvps.com with as much detail as possible, including timestamps, IP addresses, and a description of the activity. All reports are treated confidentially.
